1. About Us 

Salayfa was established in 2017 by a mother and her four daughters – each with their own take on modest fashion.

Growing up, the task of finding clothing that both looked good and was fully able to cover us seemed almost impossible – there was always a need for a jacket or an inside top, which didn’t always look as good as we’d hoped!

And that is how Salayfa was born!

Our aim is to help provide women with stylish and flattering clothing without the need to compromise on her personal ethics and beliefs. Something we totally believe is that modest fashion is not just for the Muslim woman, but for women of all faiths and backgrounds!

Here at Salayfa, we think that women deserve to feel special. So we try to ensure that there is a level of exclusivity in our clothing. All our clothing is made in low runs so as to ensure the likelihood of bumping into someone wearing the exact same thing as you is as low as possible!

We also have a high standard of values here at Salayfa. It is our responsibility to ensure that our clothing is produced in a safe and healthy environment.

The people who make them are well cared for and paid fairly.

We do NOT partake in child labour of any kind.

2. Salayfa respects your right to the privacy of the personal information you provide us on our website. To that end, unless you designate otherwise or we state otherwise in this policy or at the time information is collected, any personal information you provide to Salayfa will be known only to two parties: you and Salayfa. The following policy is intended to explain how your personal information will be treated as you make use of our site and its features. Personal information includes your full name, street and e-mail addresses, billing information, click-through activity and any other personal information you may provide here. This policy may change from time to time, so please check back periodically.

3.1. It shall be your responsibility to ensure that any products, services or information available through the Website meet your specific requirements.

3.2. We will not be liable to you if the Website is unavailable at any time.

3.13. We reserve the right to disclose such information to law enforcement authorities as we reasonably feel is necessary should you breach this agreement.

4. Registration

4.1. When registering on the Website you must choose a username and password. You are responsible for all actions taken under your chosen username and password.

4.2. By registering on the Website you undertake:

4.2.1. That all the details you provide to us for the purpose of registering on the Website and purchasing the Goods are true, accurate, current and complete in all respects

4.2.2. To notify us immediately of any changes to the information provided on registration or to your personal information

4.2.3. That you are over 18 or if under 18 you have a parent or guardian’s permission to register with and purchase the Goods from this Website in conjunction with and under their supervision

4.2.7. To change your password immediately upon discovering that it has been compromised

4.2.8. To neither transfer or sell your username or password to anyone, nor permit, either directly or indirectly, anyone other than you to use them

4.3. You authorise us to transmit your name, address and other personal information supplied by you (including updated information) to obtain information from third parties about you, including, but not limited to, credit reports and so that we may authenticate your identity.

5. Eligibility to purchase from the Website

5.1. To be eligible to purchase the Goods on this Website and lawfully enter into and form contracts with us, you must:

5.1.1. Be 18 years of age or over

5.1.2. Be legally capable of entering into a binding contract

5.1.3. Provide full details of a delivery address in the United Kingdom

5.2. If you are under 18, you may only use the Website in conjunction with, and under the supervision of, a parent or guardian. If you do not qualify, you must not use our Website.

6. Price

6.1. The prices of the Goods are quoted on the Website.

6.2. Prices for delivery are quoted for delivery in the United Kingdom unless otherwise specified.

6.3. Unless otherwise stated, the prices quoted include VAT but exclude delivery costs (in the case of goods) which will be added to the total amount due from you. Details of our delivery charges can be located on our Website.

6.4. We reserve the right, by giving notice to you at any time before delivery or performance of our obligations to you, to increase the price of the Goods to reflect any increase in the cost to us due to any factor beyond our control (such as without limitation, any foreign exchange fluctuation, significant increase in the costs of labour, materials or other costs of manufacture). 

7. Payment

7.1. Payment can be made by any major credit or debit card or PayPal

7.2. By placing an order, you consent to payment being charged to your debit/credit card account or electronic payment account as provided on the order form.

7.3. Payment will be debited and cleared from your account before the dispatch of the Goods to you.

7.4. When you pay for your order by card, we carry out certain checks which include obtaining authorisation from your card issuer to ensure you have adequate funds and for security reasons. This may involve validating your name, address and other personal information supplied by you during the order process against appropriate third party databases including the card issuer, registered credit reference agencies and fraud prevention agencies.

7.5. By accepting these Conditions you:

7.5.1. Undertake that all the details you provide to us for the purpose of purchasing the Goods are correct and that the payment card you are using is your own and that there are sufficient funds to cover the cost of the Goods ordered

7.5.2. Undertake that any and all Goods ordered by you are for your own private or domestic use only and not for resale

7.5.3. Authorise us to transmit the payment and delivery information provided by you during the order process (included any updated information) for the purpose of obtaining authorisation from your card issuer to ensure you have adequate funds, to authenticate your identity, to validate your payment card and for other security reasons, such as fraud prevention

7.6. We shall contact you should any problems occur with the authorisation of your card.

7.7. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from our Website.

8. Order process and formation of a contract

8.1. All orders are subject to acceptance and availability. If any Goods ordered are not available, you will be notified by email and you will have the option either to wait until the item is available or to cancel your order. It is your responsibility to provide us with a valid email address so that we can contact you if necessary.

8.2. Any order placed by you constitutes an offer to purchase the Goods from us.

8.3. All such offers received from you are subject to acceptance by us and we reserve the right to refuse any order placed by you at any time prior to acceptance, without providing an explanation.

8.4. You shall be responsible for ensuring the accuracy of the details provided by you during the order process and we will not accept an order unless all details requested from you have been entered correctly.

8.5. You agree that if we contact you to acknowledge receipt of your order such communication shall not amount to our acceptance of your offer to purchase the Goods ordered by you from the Website.

8.6. A contract between you and us (the ‘Contract’) incorporating these Conditions will only subsist after we have debited your payment card and have confirmed that we have dispatched the Goods We will send you an email to confirm this (a ‘Confirmation Notice’). The Confirmation Notice will amount to an acceptance of your offer to purchase from us. The Contract will be formed when we send you the Confirmation Notice (whether or not you receive it).

8.7. The Contract will relate only to the Goods stated in the Confirmation Notice. We will not be obliged to supply any other Goods which may have been part of your order until we have sent you a separate Confirmation Notice relating to it.

8.8. You must check that the details contained in the Confirmation Notice are correct and you should print out and keep a copy of it.

8.9. You will be subject to the version of our policies and Conditions in force at the time that you order the Goods from us, unless:

8.9.1. Any change to those policies or these Conditions is required to be made by law or governmental authority

8.9.2. We notify you of any change to our policies or these Conditions before we send you the Confirmation Notice, in which case, we are entitled to assume that you have accepted it, unless we receive written notification from you to the contrary within seven calendar days of receipt of the Confirmation Notice

9.Delivery

9.1. The Goods will be delivered to you at the address you provided during the order process which must be the address that is the billing address of your payment card.

9.2. We employ professional carriers. Nevertheless, you must examine the Goods on arrival. If you are asked for your signature on delivery, you must examine the Goods before signing for them.

9.3. Any dates quoted for delivery of the Goods are approximate only. If no date is specified then it will take place within 30 days of the date of the Confirmation Notice, unless there are exceptional circumstances.

9.4. We will not be liable for any delay in delivering the Goods. 

9.6. For Christmas deliveries, we recommend that you check our Website for the last date of delivery. We will endeavour to dispatch all Goods that are in stock within 72 hours. However, we cannot guarantee delivery by 24th December.

10.Risk and title

10.1. The Goods will be at your risk from the time of delivery.

10.2. Ownership of the Goods will only pass to you when we receive full payment of all sums due in respect of them including VAT and the cost of delivery.

11.Cancelling your Contract and returns

11.1. Cancelling before receiving a Confirmation Notice

11.1.1. You may cancel your order for the Goods at any time prior to receiving a Confirmation Notice from us by notifying us of your decision to cancel.

11.1.2. You may notify us by sending us an email to info@salayfa.com quoting your name, address, the name or a description of the Goods and your order reference number.

11.2. Cancellation after receiving a Confirmation Notice

11.2.1. You may cancel this Contract at any time before the expiry of 14 calendar days after the day you received the Goods (the ‘Cancellation Period’) by notifying us of your decision to cancel.

11.2.2. You may notify us of your decision to cancel by sending us by email to info@salayfa.com

11.2.2.1. the fully completed cancellation form found on the Website, or

11.2.2.2. a statement of your name, address, the name or a description of the Goods 

and your order reference number.

13.General

13.1. We reserve the right to change the domain address of this Website and any services, products, product prices, product specifications and availability at any time. 

14. Traffic Data

14.1 Each time a visitor comes to the Salayfa website, our servers — like most on the web — collect some basic technical information, including, for example, the visitor’s domain name, referral data and browser and platform type.

14.2 We also count, track and aggregate the visitor’s activity into our analysis of general traffic flows at our sites. To these ends, we may merge information about visitors and visits into group data, which may then be shared on an aggregated basis with our advertisers; but we will not disclose your individual identity or personally identifiable data without your permission. When we do present aggregated information to outside companies, no one will be able to identify you or contact you.

15. Use of Cookies

15.1 A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer’s hard drive. We use cookies in a limited way to help deliver advertisements, to identify unique browsers that visit us and to track usage throughout our site.

15.2 The information about readership and site usage that Salayfa collects through cookies is aggregated into general reports about readership and not tied to individual identities.

15.3 Other companies which place advertising on our site also have the ability to assign their cookies to you in a process that HabibaDaSilva.com does not control. However, cookies cannot be used to identify individuals, only machines, so these advertisers will not know who you are.

16. Disclosure Of Personal Information

16.1 Salayfa will not otherwise use or disclose your personal information without your consent except (i) as described in this privacy policy, or (ii) as required by law to be disclosed. This policy does not protect information you post to any online bulletin board, chat room, newsgroup or other public forum within our website.

17. Returns


17.1 We accept returns within 14 days following the receipt of your delivery. Please ensure the returns form provided with your delivery is filled out. If a new returns form is required, please contact us and we will send a new form to you via email (please check junk/spam folder).

17.2 Returned items must be unworn and sent back inside their original packaging with Salayfa swing tags still attached to the item. Any stained or faulty goods we receive will be returned to the customer and no refund will be provided. We cannot accept returns that have been damaged in any way due to incorrect washing or use.

17.3 Sealed goods (ie. perfumes) are not suitable for return due to health protection or hygiene reasons.

17.4 We cannot be responsible for lost return shipments so we recommed sending your parcel to us via tracked delivery. Customers must keep track of their own parcel to ensure it reaches us.

17.5 Salayfa will not refund any items returned to us which get lost in the post without a tracking number, and which are not signed by us upon delivery. Goods are returned to us at your own expense.

17.6 Once we receive your package, please allow up to 14 days for processing. Shipping fees are non-refundable.

17.7 Full refund of the cost of the items is entirely conditional based on goods being returned in the original packaging and in a re-sellable condition.

21. Data Protection

21.1 We may collect the following personal information from users of the Website: name, e-mail address, postal address, telephone number, date of birth, gender and bank account number (provided by the customer in case of refunds) when the user visits the Website, places an order online, contacts our team or participates in promotions or questionnaires.

21.2 In all cases, the details requested via the Website are necessary to provide an optimal service to the user. In cases where the user does not provide the requested details, we cannot guarantee that the information and services provided will fully satisfy their needs.

21.3 Salayfa uses your personal details to:

21.3.1 Improve the shopping experience.
21.3.2 Process their online orders, including the sending of e-mails to inform them of delivery status.
21.3.3 Process order returns.
21.3.4 Contact them if there is any problem with any of their orders or for other logistical reasons.

21.4 We expressly informs and guarantees users that their personal details will not under any circumstances be forwarded to third party organisations and that before forwarding personal details, it will request the express, informed and unequivocal consent of the owners of the same.
